Terms of Service

Agreement and authority

These Terms govern access to Firework OS by the subscribing company and its authorized users. The person accepting these Terms represents that they have authority to bind the subscribing company. A separate signed order form or written agreement controls if it expressly conflicts with these Terms.

Month-to-month subscription and recurring billing

Paid Firework OS subscriptions are month-to-month. The subscription automatically renews for successive one-month periods until cancelled. Subscription fees are billed in advance each month through the payment method maintained with our payment provider.

The customer authorizes Firework OS and Stripe to charge the recurring monthly subscription fee, applicable taxes and any separately approved usage or services. A failed payment may result in notice, retry, restricted access or suspension.

Trials, cancellation and refunds

If a trial is offered, its length and included services are stated in the offer or order form. A paid subscription starts only after the customer affirmatively selects a package and completes the applicable billing setup.

The customer may cancel at any time through the billing portal or by contacting hello@fireworkos.com. Cancellation takes effect at the end of the current paid monthly period. Fees already paid are not prorated or refunded except where required by law or expressly agreed in writing.

Price changes

Firework OS may change recurring prices by providing at least 30 days' notice before the new price applies to a renewal. The customer may cancel before that renewal if it does not accept the change.

Authorized use

The customer is responsible for its users, account security, accurate data and lawful use. Users may not bypass access controls, access another tenant, interfere with the service, reverse engineer protected components, introduce malicious code or use Firework OS to violate law or third-party rights.

Regulatory workflows

Firework OS is designed to support recordkeeping and operational workflows used by professional fireworks companies when working with ATF, DOT, state and local regulatory bodies. Firework OS is not a regulator, law firm or compliance certification service. It does not provide legal advice, guarantee compliance or replace the customer's obligation to confirm current requirements with the appropriate authority.

Customer data

The customer retains ownership of its business data and grants Firework OS the limited rights needed to host, process, secure, support and transmit that data to provide the service. Tenant access controls do not replace the customer's responsibility to authorize its users and maintain appropriate source records.

Privacy and service providers

The Privacy Policy describes personal-information practices. Firework OS may use the service providers listed on the Subprocessors page to operate the service.

Availability and changes

Firework OS may update features to improve security, reliability or functionality. No internet service is uninterrupted or error-free. Preview, beta or online-only features may change and should not be treated as the sole source of emergency, safety or legally required information.

Suspension and termination

Firework OS may suspend access when reasonably necessary to protect users, tenants, the platform or third parties; address unlawful use; respond to a security risk; or resolve materially overdue fees. Either party may terminate for a material breach that is not cured within a reasonable written notice period.

Disclaimers and liability

To the maximum extent permitted by law, the service is provided without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Firework OS is not responsible for operational, safety, firing, transportation or regulatory decisions made by the customer. Liability limitations in an applicable order form or written agreement control.
